Gang Injunctions
City Attorney Dennis Herrera obtained civil injunctions against seven violent street gangs that have plagued San Francisco neighborhoods with their criminal and nuisance conduct. The civil gang injunctions were never envisioned as a panacea for crime, but they have played a role — alongside the work being done by San Francisco’s Police Department and San Francisco’s District Attorney — in reducing gang related violence and nuisance conduct.
In San Francisco, only a judge can place someone under a gang injunction. This can only happen after clear and convincing evidence is presented during an open court hearing. San Francisco also has an “opt out” process to be removed from the court-ordered injunction. The opt-out process both maximizes civil liberties protections and ensures the effectiveness of civil gang injunctions to protect San Francisco neighborhoods. Gang Injunctions
Since the end of 2006, City Attorney Dennis Herrera has obtained four civil injunctions against seven violent street gangs that had been plaguing San Francisco neighborhoods with their criminal and nuisance conduct. Each injunction covers one of four geographic areas.
